Stephen J. Penino

Mr. Penino is a graduate of both Fordham University and the Fordham University School of Law.

He commenced the practice of law in 1985 as an Assistant District Attorney at the Queens County District Attorney’s Office in New York City.  Mr. Penino served as a Prosecutor for nearly four years in both the Rackets & Economic Crime and Homicide Bureaus, where his litigation skills were developed and honed.

Subsequent to serving as a prosecutor Mr. Penino began his work in the Insurance Defense area.  Initially he worked as an associate at a major Manhattan firm specializing in Medical Malpractice Defense litigation.  In 1991 he relocated to the White Plains area of Westchester County where he has practiced to this day.

His work in Westchester centers around Insurance Defense and Commercial Insurance Defense matters and Real Estate Broker Errors & Omissions suits.  He has conducted numerous Risk Management Seminars for local real estate brokers.  These have been met with great enthusiasm by the local brokers.  He also has conducted numerous seminars in the area of Labor Law and lead paint tort claims.

Mr. Penino is also a member of the American Trial Lawyers Association, the New York State Trial Lawyers Association and the State Bar Association.

Steven J. Monn

Mr. Monn is currently a partner at Penino & Moynihan, LLP.

Mr. Monn is a graduate of Brooklyn College of the City University of New York, and the Benjamin N. Cardozo School of Law and has been a trial attorney for over thirty years.

He commenced his practice of law in 1983, as a staff attorney for the New York City Legal Aid Society where he defended indigent defendants in significant criminal actions throughout his tenure with the Society.

Before joining the Firm of Penino & Moynihan, LLP, Mr. Monn was a partner and senior litigator of a major defense firm.

He has a vast experience in the field of insurance defense in both first-party and third-party litigation. He specializes in construction site litigation, brokers’ liability, premises, auto liability and first-party litigation. He has counseled the Special Investigation Units of several major insurers in fraud prevention and detection.

His clients include several major national retailers, supermarkets, and claims service providers. He has served clients in Upstate New York, Hudson Valley Region, New York City and Connecticut for over twenty years.

He is admitted to practice before the State and Federal Courts of New York and Connecticut and The United States Court of Appeals for the Second Circuit. He is a member in good standing of the National Retail and Restaurant Defense Association (NRRDA).

Brian S. Frank

Mr. Frank graduated in 1995 from Hamilton College in Clinton, NY, where he earned a Bachelor of Arts degree in History.   He then attended Pace University School of Law in White Plains, NY, and earned his Juris Doctorate in 1998.  He is admitted to practice in the state courts of New York and Connecticut, as well as the Federal Courts in Connecticut and the Southern and Eastern Districts of New York.

While attending Pace Law, Mr. Frank won the first Pace University School of Law Unified Moot Court Competition, and was a member of a Moot Court team, fielded by the school, that competed in the 1997 National Health Law Moot Court Competition in Carbondale, Illinois.  While attending law school, Mr. Frank clerked for a law firm in Katonah, NY, which retained him full time upon graduation.

Mr. Frank has been associated with Penino & Moynihan, LLP since May, 2009.  His practice areas have included the spectrum of civil litigation and appeals, with an emphasis in insurance defense.  Mr. Frank has extensive prior experience in insurance coverage disputes, and has previously represented insurers in coverage actions in California, Louisiana, Illinois and Florida.  Mr. Frank also has considerable experience defending municipalities in both New York and Connecticut jurisdictions.

Heather A. Backman

Ms. Backman is presently an Associate Attorney at Penino & Moynihan, LP. She handles a wide range of cases involving multiple aspects of insurance defense litigation such as motor vehicle accidents, premises liability, dog bites and property damage. Prior to joining the firm in 2013, Ms. Backman worked for a prominent defense firm where her practice areas included general insurance defense litigation and medical malpractice defense. Ms. Backman is a graduate of New York Law School and the State University of New York at Albany. She is licensed to practice law in New York and Connecticut.

Linda Lin

Linda Lin graduated from Barnard College of Columbia University and Pace University School of Law. As a law student, Ms. Lin was sworn in a Student Assistant District Attorney with the Manhattan District Attorney’s Office, specializing in the prosecution of domestic violence cases. Ms. Lin commenced the practice of law as an insurance fraud attorney. She then practiced family law with the Pace Women’s Justice Center.

She represented victims of domestic violence in Family Court and Integrated Domestic Violence Court, supervised law students operating under student practice orders, conducted police trainings on domestic violence and the law, directed her own projects, and was promoted to Managing Director. After working in the public sector, Ms. Lin served as a legal recruiter before practicing family law, matrimonial law, and civil litigation in the private sector. Ms. Lin is fluent in Mandarin Chinese and is admitted to practice law in New York and Connecticut.

Jeffrey T. Beauchesne

Mr. Beauchesne is presently an Associate at Penino & Moynihan, LLP.

Mr. Beauchesne graduated with honors from Syracuse University and Campbell University School of Law. He is admitted to practice in New York State and North Carolina.

Upon graduating law school, Mr. Beauchesne worked for a prominent Insurance Defense Firm in Midtown Manhattan. Mr. Beauchesne joined Penino & Moynihan, LLP in January of 2017.

Prior to graduating from law school Mr. Beauchesne worked in the Harnett County District Attorney’s office as an Assistant Prosecutor under the third-year practice rule. Mr. Beauchesne also worked for former North Carolina State Representative Richard Glazier, Esq., where he worked on drafting legislation that was voted into law. Finally, Mr. Beauchesne has done an array of pro-bono legal work that includes writing Wills for military veterans, and working to expunge criminal records of those that have rehabilitated their public standing.

Casey Butterly

Mr. Butterly is presently an Associate at Penino & Moynihan, LLP. He handles a diverse range of cases, including general liability, personal injury, motor vehicle accidents, premises liability, and property damage actions.

Prior to joining Penino & Moynihan, Casey focused his career on general litigations, and was an associate at a prominent New York insurance defense firm. He has experience in briefing appeals before the Appellate Division.

Casey received his B.A. in History and Philosophy from Fairfield University and his J.D. from William and Mary Law School.

Nicole M. Massi

Ms. Massi is presently an Associate Attorney at Penino & Moynihan, LLP. Ms. Massi received her J.D. from New England School of Law | Boston in 2014 and her B.A. in Philosophy, Politics and Law from Binghamton University in 2011. She is admitted to practice in both State and Bankruptcy Court of New York State. Prior to joining Penino & Moynihan, Ms. Massi represented financial institutions in commercial and residential foreclosure and bankruptcy matters.

Laurie E. Dallos

As an Associate Attorney at Penino & Moynihan LLP. She graduated from the University of Rhode Island with a BA in biology and earned a Juris Doctor from Touro Jacob D. Fuchsberg Law School and an LLM in Environmental Law from Pace University School of Law. She is admitted to practice in the Southern and Eastern Districts of New York, US Court of Appeals for the Federal Circuit and D.C Circuit and the US Supreme Court. Her areas of practice include insurance defense, environmental, commercial and securities litigation, as well as immigration law and appellate practice. She has participated in extensive pro bono work in the areas of environmental and immigration law and is a Certified Part 36 Guardian Ad Litem in New York. She will be sitting on the Board of Directors for the New Rochelle Bar Association in Fall, 2018.

John Madzula

Mr. Madzula graduated from Fairfield University with a Bachelors of Science in Marketing and International Business. He received his J.D. from Roger Williams Law School. He is admitted to practice in Connecticut, Massachusetts, Rhode Island, Florida, the Court of Appeals for Veterans Claims (CAVC), and the United States Supreme Court.

Prior to joining Penino & Moynihan, Mr. Madzula primarily practiced as a construction litigator in Connecticut and Rhode Island with a concentration in construction and construction surety law, representing owners, developers, general contractors, and subcontractors. He also spent two years in Providence, RI and as an appellate litigator practicing complex civil litigation before the CAVC representing injured and disabled veterans throughout the nation that were denied VA benefits.

Boris B. Shapotkin

Mr. Shapotkin is an Associate at Penino & Moynihan, LLP and handles a wide range of cases including, general liability, personal injury, motor vehicle accidents, premise liability and property damage actions.

Mr. Shapotkin graduated from Brooklyn College with a BS in Business Management & Finance, and he earned his JD from Pace Law School. Mr. Shapotkin is admitted to practice in New York State.

While attending law school, Mr. Shapotkin actively competed in Trial Competitions and was an Honors Prosecution Extern at the Westchester County District Attorney’s Office. Prior to joining the firm, Mr. Shapotkin focused his career on defense litigation in both criminal and civil fields. In addition to his litigation experience, Mr. Shapotkin has also represented financial institutions in commercial and residential real estate matters. Mr. Shapotkin is fluent in Russian.

Douglas W. Falch

Mr. Falch is currently a partner at Penino & Moynihan, LLP.

Mr. Falch is a graduate of Syracuse University and the Quinnipiac College School of Law.

He commenced the practice of law in 1995 as an associate at a small negligence firm in Manhattan. Since he began practicing law, he has been exposed to both plaintiff and defense work.

Subsequent to working in lower Manhattan, Mr. Falch worked as an associate at a plaintiff’s negligence firm in White Plains.  In this position, he was involved in litigating matters involving premises liability, automobile accidents, labor law and medical malpractice.

Prior to graduating from law school, Mr. Falch worked for the New York State Department of Environmental Conservation – Division of Hazardous Waste.

He is a member of the American Trial Lawyers Association, the New York State Trial Lawyers Association and the New York State Bar Association.  Mr. Falch has served as New York State Bar Association continuing legal education lecturer and has spoken at seminar’s involving Basic Tort and Insurance Law and Labor Law.

Mr. Falch joined Penino & Moynihan, LLP, in August 2000.  He is practicing in all aspects of litigation with a concentration on Insurance Defense Matters.

Noel L.C. Williams

Mr. Williams is a graduate of City College of the City University of New York, and the Benjamin N. Cardozo School of Law.  He is admitted to practice in New York State and in various Federal jurisdictions within the state, as well as the United States Supreme Court.

He commenced the practice of law in 1987 as an Assistant District Attorney in the Queens County District Attorney’s Office in New York City where he remained for seven years.  He spent the majority of his tenure successfully investigating and prosecuting major criminal defendants as a member of the Rackets/Economic Crime Bureau in the office’s Investigations Division.  He refined his litigation skills while a member of the Narcotics Trials and Trial Training Bureaus.

After serving as a prosecutor, Mr. Williams joined the corporate sector and became a Fraud Investigations Manager with the Chemical Bank (now Chase Bank) Fraud Investigations Department.  He conducted and coordinated investigations on internal and external fraud (including but not limited to: check fraud, Mortgage Fraud, identity theft, EFT fraud, consumer loan fraud, embezzlement, cyber crime, kickbacks, bribery, fraudulent financial reporting, software piracy, fraudulent insurance claims, money laundering and structuring), and corporate Code of Conduct violations.  He has conducted fraud prevention training.  In 2007, he joined Penino & Moynihan, LLP.

William A. Elder

Mr. Elder graduated in 1992 from Boston College with a BA in History and Philosophy. He earned his JD from the University of Miami in 1995.

Mr. Elder has over 18 years of insurance defense experience and has successfully tried cases to verdict in venues throughout New York. He is well versed in the defense of Labor Law, premises, automobile and products liability matters. William is an experienced appellate advocate having argued numerous cases before the Appellate Division.

He also directed the defense of a defendant in the World Trade Center Mass Tort Litigation in the District Court for the Southern District of New York. Mr. Elder currently focuses his practice on complex Labor Law and general negligence defense cases.

Henry L. Liao

Mr. Liao received his J.D. from Pace University School of Law and his B.A. from the State University of New York at Binghamton.  He joined the firm in 2006 and is admitted to practice law in New York.

Karen K. Lutt

Ms. Lutt is a graduate of Brooklyn Law School and The State University of New York at Albany.

She commenced the practice of law as an Assistant Corporation Counsel for the City of New York, practicing commercial litigation. Subsequent to working for New York City’s Law Department, Ms. Lutt began her work in the insurance defense area as an associate in the offices of the New York City in-house counsel to Cigna Property and Casualty Insurance Company. Ms. Lutt practiced in this area for approximately eight years.

In addition to her litigation experience, Ms. Lutt practiced in the area of trusts and estates and elder law for approximately ten years. She is also a former Certified Part 36 Guardian ad litem and Court Examiner for the Ninth Judicial Law District. Ms. Lutt is admitted to practice in New York in the State Courts as well as the Eastern and Southern District Courts of New York.

Scott D. Taffet

Mr. Taffet is currently a partner at Penino & Moynihan LLP. He graduated from the University of Pennsylvania College with a BA in Political Science and History. He then attended New York Law School and earned his Juris Doctorate.
While attending New York Law School, Mr. Taffet wrote for the CityLaw Journal and interned for the New York City Office of Labor Relations, the New York City Office of Collective Bargaining, and the general counsel of Ralph Lauren.
Mr. Taffet began his career at Penino & Moynihan as an associate before being elevated to partner in April of 2017. He manages the firm’s auto litigation department where he oversees cases from inception to trial.

Melissa L. Vincton

Ms. Vincton is an associate with the firm who focuses on Insurance Defense matters in Upstate New York. Her practice includes defending claims involving motor vehicle accidents, injuries on premises, dog bite incidents, and construction accidents.

Ms. Vincton graduated with honors from SUNY Brockport and the University at Buffalo School of Law. She participated in Moot Court and National Trial Competitions during law school. She served as a student law clerk for the Honorable Richard C. Kloch, Sr. in Niagara County Supreme Court.

She has been defending personal injury lawsuits through all phases of litigation since her admission to practice in New York in 2010. Ms. Vincton is an experienced trial and appellate attorney. She currently sits on the Board of Directors for the Defense Trial Lawyers Association of Western New York.

Evan H. Echenthal

Mr. Echenthal received his Juris Doctor in 1991 from Thomas M. Cooley Law School. Thereafter Mr. Echenthal was an Assistant District Attorney in the Special Prosecution Division for Westchester County prosecuting cases involving sex crimes, domestic violence and child abuse. Since 2003 Mr. Echenthal has represented and defended insureds in matters involving NYS Labor Law, premises liability, motor vehicle liability, vertical transportation and subrogation from inception through trial and verdict.

Rafael Otero

Mr. Otero has over 30 years of insurance defense experience and has defended cases to verdict in venues throughout New York. He defended medical malpractice cases as outside counsel on behalf of The City of New York and other hospitals including mental institutions. He is well versed in New York Labor Law, premises, automobile and products liability matters.

He also directed the defense of a defendants in “sick building”, lead paint and asbestos litigation. He is admitted in the District Court for the Southern District of New York. Mr. Otero currently focuses his practice on complex Labor Law and general negligence defense cases.

Emily Mann

Emily Mann graduated from Bethany College in Bethany, WV with degrees in History and Political Science, and received her Juris Doctorate from St. John’s University in 1999. She is admitted to practice in New York and Connecticut as well as in the United States District Courts in the Southern and Eastern Districts of New York. Prior to joining Penino & Moynihan LLP, Ms. Mann worked at an international insurance defense firm and at several firms representing plaintiffs in personal injury cases. She has represented and defended insureds on both the trial and appellate level in matters involving Labor Law, contracts, insurance coverage, premises liability, motor vehicle liability, vertical transportation, and subrogation.

Edward J. Barbour

Edward J. Barbour graduated with a B.S. degree from Fordham University, majoring in Psychology and Economics, Fordham University. He received his J.D. from the Pace University School of Law and is AV® Rated as a Pre-Eminent Attorney by Martindale-Hubbell. He began his 35-year legal career as an Assistant Corporation Counsel for the City of Yonkers (1984-1985, 1987-1989), primarily handling tort-related matters and serving as the lead attorney for the Building Department, the Zoning Board of Appeals and the Real Estate Department. He thereafter served as a Court Attorney with the Office of Court Administration, researching and drafting opinions for the court, conferencing and settling cases and serving as liaison between the bench and bar. His next positions included serving as an in-house attorney for Cigna Insurance Company and Zurich Insurance, handling personal and commercial line cases involving premises liability, motor vehicle accidents, environmental matters, Labor Law and construction defect matters. Additionally, during his career, he has handled advertising injury cases, municipal and school liability cases, hotel and resort cases and assault cases. He has completed an intensive N.I.T.A. trial advocacy skills-based course. Most recently, and prior to his new relationship with Penino and Moynihan, he was associated with a firm exclusively handling Tower Insurance and Amtrust insurance matters. He has served as a Former Vice President and Secretary of the Yonkers Lawyers Association, been a Yonkers Judicial Screening Committee member and was a former member of the Board of Directors of the Westchester County Bar Association. Mr. Barbour is admitted to the New York State Bar, as well as the Southern and Eastern Districts of the United States District Courts.
